On February 16, 2017 the New York Board of Appeals agreed with Global Cash Card, a national provider of payroll debit cards, who filed a motion that the new ruling was outside of invalid and outside of their authority. The new regulation, that was to take effect on March 7, 2017, has been revoked and the New York Department of Labor has 60 days to appeal the court's ruling.
You may recall, New York had recently issued a regulation regarding payments of wages by direct deposit and paycards. Not only was this regulation a huge burden for employers but Global Cash Cards alleged it was invalid or unreasonable. The American Payroll Association also commented on how the implementation of the new regulation would interfere with employers offering payroll cards. As long as certain conditions are met (ex. no fee to access wages) Companies can offer payroll cards to their employees and they do not need to use the consent template recently released.
